In 2023, the Southern Ute Indian Tribal Council adopted a Tribal Environmental Review Policy Code (“TERP Code”) at Title 31 of the Southern Ute Indian Tribal Code. The TERP Code applies to activities on tribal trust land requiring tribal approval in lieu of federal approval under either: (1) a tribal energy resources agreement, 25 U.S.C. § 3504; or (2) tribal surface leasing regulations under the HEARTH Act, 25 U.S.C. § 415(h). See TERP Code at § 31-2-102.
